Process
First of all, it is crucial to check whether the seller is the property’s owner, whether the property is free of loads, or whether certain conditions must be observed. The land register is an electronic register maintained by the district courts and which you can consult electronically at any time in the Notariat Mariahilf. We will check the current land register status for you.
As a competent partner, we offer a comprehensive real estate package with the protection of your interests and the protection against unpleasant surprises. If you decide to buy or sell a property, we can draw up a purchase agreement in which all rights and obligations are regulated in addition to the purchase price. If necessary, we take care of the release of the goods in addition to the seller. In the case of real estate transactions, we particularly recommend having the purchase price deposited in a trust account to secure both sides.

Fiduciary
All trusteeships that the Notariat Mariahilf manages are registered in the Registry of Trustees of the Austrian Notariat and thus enjoy insurance cover. The purchase price payment only takes place when all agreed conditions have been met, such as the release of the object from the burden and the buyer’s registration in the land register. For the buyer, this means that the purchase price will only be paid out if it has already been entered in the land register or reserved. On the other hand, the seller is assured that the money is actually deposited before the change of ownership and is transferred to him according to the order.

Real estate contract
A condominium agreement establishes a legal right to use and dispose of the individual apartments and other objects in a building. A written appraisal forms the basis for this agreement.
In this report, all the condominiums and other independent units, such as storage rooms and garages in the building, are accurately described, along with their components. The report also lists the rooms and areas not part of any single apartment, known as common areas but available to all the building owners. This will give you a clear idea of what is included in your apartment property and which parts of the building are shared. Sales consulting
As a seller of a property, you can also benefit from the expertise and experience of the Notariats Mariahilf. Before signing a contract, some essential points should be clarified. This includes, in particular, the so-called “exemption from charges”, which usually has to be taken over and paid by the seller. This involves the deletion of encumbrances, such as registered liens, from the land register. The effects of the real estate income tax that the seller has to pay should also be considered. Based on your information, I can assess the sale from a tax perspective and prevent possible financial surprises.
